Injunctions / Restraint Orders

Freezing and restraint orders are becoming increasingly common, and can have a devastating effect on the life of an individual. 

All cash and assets may be frozen, with permission given by the court to only draw what you may regard as hopelessly inadequate amounts of weekly survival expenses from a designated account.

Monies frozen, although maybe belonging to others e.g. your family, will often be caught up in these freezing orders for months, or even years, and require very carefully prepared applications for release of monies to be made in court.

You may be forced to use public funding (Legal Aid) to prepare your defence which will not meet most people's expectations as to the grade of solicitor and expert who does the work, the preperation time allowed or the amount of investigative work and expenses which will be funded.

Freezing/restraint orders are often made without a person even knowing they have been made!

Quite often, a person will find themselves subject to a freezing order which has been applied for by an authority, and made by a judge in a private hearing.

In addition to freezing the assets of a person, a judge can order disclosure of a persons' assets internationally so that freezing orders can be made against all assets.

There are limitations to the enquiries that an authority can make and they must justify why they are making the enquiry.
