How can we help?

Mediation (or conciliation) is one remedy for resolving a legal dispute without the need for court proceedings.  It involves an independent third party (the mediator) who assists the parties in resolving their dispute.  It can provide a quick and cost effective means of reaching a solution and because of this is an attractive alternative to litigation.

Other forms of alternative dispute resolution (or ADR) include arbitration, expert determination, early neutral evaluation, judicial appraisal and Med-arb (which is a hybrid where parties agree to mediate and if that fails, their case is referred to arbitration).  Even negotiations in correspondence between solicitors at an early stage can help prevent an issue between parties escalating into a full blown dispute.

Even if a case is started in the Civil Courts, increasingly parties to actions find that they are encouraged by judges to consider mediation or some other form of ADR, in an attempt to resolve disputes more speedily than they would do at Court.  Even if a dispute is being litigated, parties can still participate in ADR at any point before trial even without the Court’s intervention.
