Uninsured motor claims made simple
Dealing with a road traffic accident, whether as a driver, passenger or pedestrian, can be stressful at the best of times and even more so if the other party involved is found to be uninsured.

A claim can be pursued through the Motor Insurers' Bureau (MIB) for both personal injury and associated financial losses, for example, vehicle damage and loss of earnings.
The MIB is an insurance backed agency set up to deal with the claims for victims of uninsured and untraced drivers and is a fund of last resort. They essentially act as the insurer for the uninsured or untraced party if they are found to be at fault.
In the event of an uninsured claim your legal costs would also be recoverable from the MIB and your claim can, in most cases, be dealt with on a no-win no-fee basis.
- A claim form must be submitted to the MIB with any documentation in support, for example any letters sent to the third party asking for insurance details and any documents from the Police.
- If you have comprehensive motor insurance you cannot claim for the damage to your vehicle, if any, and you must liaise with your own insurer in this regard.
- A £300 excess applies to claims for special damages (financial losses) for example the damage to your car or clothing etc. This is deducted once from the total you are claiming.
- The standard limitation period of 3 years applies to Uninsured motor claims, which means your claim must be brought within 3 years of the date of the accident.
