Road Accident - Significant Brain Damage

Stress/Stroke injury at work

In 2005 we created new law regarding the legal test concerning reasonable foreseability. We represented David Donachie a Greater Manchester Police officer whose case surprisingly was not funded by the Police Federation .The Judge Tetlow found against our client on the point in Manchester County Court. However, we appealed his decision to the Court of Appeal and the three appeal judges accepted our submissions and found for Mr Donachie.

Mr Donachie recovered significant compensation, as he had suffered a stroke as a consequence of the tremendous pressure he was under when fitting a tracking device which went on to fail 9 times! This case was reported extensively in the media resulting in Martin Coyne being interviewed by Peter Allen and Jane Garvey on the BBC 5 Live Drivetime programme.

The Criminal Injuries Compensation Appeal Tribunal - PTSD

In December 2005 we succesfully persuaded the Criminal Injuries Compensation Authority to re-open a decision it had made in 1993 in awarding our client only £17,500. At the time of his injury he was a member of the Royal Marines Band and was injured by the IRA bomb at Deal Barracks. We took the case to appeal and recovered several hundred thousand pounds for him in compensation as he had suffered a severe post traumatic stress disorder (PTSD).  You can read the full article here.

Multiple trauma - Road Accident - Swedish National

In 2005 we successfully recovered a seven figure sum for a Swedish client who was injured by a Dennis Dart bus at the NEC. This case was handled by Martin Coyne. The case demanded several trips to Sweden over 4 years to obtain instructions. He was a large man and was completely run over by the bus. He suffered multiple trauma and was on the ICU at Birmingham Heartlands hospital. He was air ambulanced back to Sweden where he remained in hospital for 22 months.

His wife reported that he was being neglected by his Swedish doctors due to his MRSA infection contracted in the UK. Martin Coyne decided to take Professor Anthony Redmond OBE with him to Sweden to find out what could be done medically. The representative from the Norwich Union and their solicitor also attended. As a result the Norwich Union saw how ill our client was and agreed immediately to fund rehabilitation at a different hospital which we had located in Gothenburg.

That move saved our clients life and gradually he got better until eventually he was able to go to his home, which we had adapted dramatically, to meet his needs. This case is significant as this was the first case that Norwich Union had come across where the clients solicitor had brought in a medical expert to oversee the clinical treatment. As a consequence, in such cases the Norwich Union now appoint such an expert as soon as possible to see if any better rehabilitation can be offered.
