Can I make a personal injury claim?

Health and Safety statistics for 2005/06 indicate there are over 300,000 reportable work-related injuries per year, 40% of these are caused by manual handling, lifting or carrying.

Manual Handling 

Injuries caused by lifting, pulling, pushing, carrying, moving or putting down any type of object or load. The most common injuries are to the back but other muscular injuries to upper and lower limbs are not uncommon.

Defective or Dangerous Equipment or Machinery

Injuries caused by faulty, poorly maintained or dangerous equipment; defective parts of machinery, such as faulty guards/safety switches.

Slips and Trips

Injuries caused by slips on spillages, slippery surfaces or by wearing unsuitable footwear; tripping over items left on the floor or as result of a poorly designed work space.

Construction/Building site Accidents

Generally these are dangerous places and a considerable proportion of work-related accidents are of this type. Many injuries result from falling from heights or down unguarded holes, or being struck by falling objects.

Lack of Protective Equipment

Many injuries result from a lack of protective equipment such as safety footwear, safety gloves, hard hats, masks, safety goggles, particularly in circumstances where you are exposed to harmful or dangerous substances.

Lack of Training

Your employers are under a duty to ensure you are adequately trained in the workplace, both on the system of work and any equipment you may use, including personal protective equipment. It is no defence for employers to allege training was unnecessary due to previous experience in a similar role.

Employees exposed to violent attacks

This could involve patients, customers or even colleagues.
