Can I make a personal injury claim?

Holidays abroad are supposed to be a time for relaxation and enjoyment or excitement and adventure. Unfortunately however, individuals on holiday do sometimes have accidents and sustain injuries overseas.

Importantly, for those who suffer an injury on holiday abroad, there is a remedy.

Tour operators can be pursued in the UK for compensation for personal injury and other associated losses provided the holiday was a package holiday. The package usually includes transport and accommodation and would normally be purchased from a tour operator in the UK.

Bringing a claim against a tour operator in the UK is easier than bringing a legal action in the country where the accident, injury or illness occurred.

Tour operators may typically be liable for:

  • slips/trips in accommodation, including slips around the pool side
  • accidents on excursions such as scuba diving excursions where insufficient safety equipment was provided
  • food poisoning 
  • Injuries caused by dangerous swimming areas

Even if an individual suffers injury abroad whilst not on a package holiday, claims can in certain circumstances, be brought in the UK courts for appropriate compensation.
